When are we going to see the legal challenge to the anti-gay marriage laws in the domain of definition?

I mean there is no biological nor socially stable definition of gender. We now have tens of thousands of post-op transsexuals, in both directions. There can be no legal definition of gender.

When are the courts going to start ruling on that issue?
